    Because an ACCIDENT occured . That is totally different from the TENANT / LANDLORD issue compared to DRIVER / LAW ENFORCER issues .

    And if you do decide to try this, the traffic officer can pick anyone of the charges:

    *Resisting arrest (I'm not giving it)
    *Failure to carry a drivers license (I have it, just not now)
    *Obstruction of Justice (Willful withholding - I don't know where it is)
    *Impeding a person of authority from performing his duty (No, Just give me a ticket) this charge differs if it is a traffic investigator, traffic enforcer, civilian deputized agent or traffic police - traffic police (Uniformed police officers from traffic command) can have the car impounded outright if you give them this reason, when in an accident.

    and that's not all of it, not including all the other things he can do to the vehicle.

    This is a supplementary note on the question if it is legal to hold an original document as security. At this point, it is already beyond the matter of identification and the question this quote answers is if it was legal to use a passport for security.
    SO let me ask you this .... would you apply that to LOCAL TENANTS also as a way of SECURITY ?

    -One could do that but it might be expensive and time consuming for short time tenants. Here's what we did: Sub meter the area for leasing, indicate last reading before occupation and note on contract. It follows Electric ***** Water ***** Aircon ****. Have an ocular inspection with tenant to view meter readings before occupation and testing , tenant will be informed that this will be the basis for his meter readings. After that just bill him separately at the prevailing rates of what he consumes.

    It becomes a problem for the next tenant since you can not replace the name of the utility with out the consent of the owner... the one you evicted. And an eviction notice may sound good but if they challenge that, you can bet on another set of grace periods. I was talking about immediate, and it can't be done... legally that is.
    That is what we call SECURITY working at your advantage . If the EX TENANT is smart enough to do stupid things , as long as voluntary wala niya gipa suppressed ang iyahang UTILITY ACCOUNT , he or she cant acquire another account if an existing one is still operating .

    Ikaduha ... it should start from the beginning . As a good systematic harmonious relationship of the TENANT and LANDLORD which was missing in the part of AJOL kay dawat ke dawta lang basta ma filled up ang units , dili kabayran ang labad sa ulo and that does not stop in the IRANIANS only .

    Why would you rent out units na high-end unya the prospective tenant was only with the company for the last 2 months ? WHy would you rent out high end units to students w/o checking their financial capabilities ? If you will get the drift , it will avoid you future headaches . No its not expensive either . Kana if you lage you know what you are doing .

    If I state my experience (including tenure as section head and deputy administrative officer - real estate company) on these matters, it would be about three (3) of you combined, so please, your 15 years is admirable but make your points noted.     So why the hostile remarks to ajol? I mean he's just trying to cope up here (Ok so it's a bit "over the top" referring to an entire race). No need to badger the poor fellow, for all we know he may have lost a lot. Let's just do a more appropriate thing, try to help the guy, he is just trying to earn an honest living. If he's wrong give suggestions in a decent and respectable manner, no need to ridicule his remarks. So he made mistakes... as if that's new.... like anyone in this business retired with a perfect record!

    I do confirm that the LTO and Citom (and some of the task force alpha personnel) are not really that knowledgeable when it comes to apprehending drivers... I checked an apprehension report and vehicle inventory sheet once (as part of my ERU service)... The apprehending officer spelled "Mask" as "Musk", the "traffic vest" was "trapffic best" (Good God and they work in traffic issues) and this was task force alpha in an operation with traffic command among others things. OT

    True that the delos reyes Vs GLS 2006 case is a traffic issue but the case and the decision on the case was on weither it was legal to hold an original document as a form security (e.g. the drivers license and similar articles) it had nothing to do with the accident itself. As matter of reference, I used it on the leeway to answer the premise "is it legal to use an original document as security?".

    Anyway, security would be more suitable if the article is of some value (in my case - the passport issue - although I it have never been comfortable) and it would save a lot if one would just stick with the monetary security deposit. If they (tenant) wishes to stay longer and they don't have money for the rent (they say - Just use our security deposit) - the polite response would be "I'm sorry, have neither the facilities nor the resource to accommodate that request... will you be requiring assistance moving out?"

    And we only use the passport as security for short time (Like 7 days).... heck I forgot to mention... we never allow them to use the entire security deposit... that's insane! asking for the passport this is merely a measure of good faith - these are in cases where the banks screw up, or they have personal problems that delay their financial capabilities - and I don't feel good if I evict a person becuase his mom's bank screwed up.

    Oh and one more thing, while the subject of being in the business since "Magsaysay was president yadda yadda yadda" may have been a metaphorical hyperbole used to illustrate a point, the fact about me being a section head and deputy administrative officer - real estate company along with its experience, was not.

    I can't put the name of the real estate company becuase its also my family's name. I think I can get Beor to vouch for me on that, actually vern, chronnus and some of the other Moderators would be a more obvious choice, he and the others were and are familiar with what I did before he (vern) went stateside... and joined the armed services.

    So to summarize.

    *If you want to keep an original passport as a form of security, you better know what you're doing - know how to do it, properly its on a gray line (Not all legal things are good - and not all good things are legal and so on.)

    Let's get this straight hehe, even the most expensive HOTEL Chains, they do not ask for the original copy of passport for their clients. You can try spend a few days in Shangrilla, Waterfront, Hilton etc etc. They are big names in the hotel industry pero dili sila mo require of original copy sa passport. Maybe a photocopy.

    Ni explain ra ko ha kay I really think it is illegal man jud. Luoy sad sa mga foreigners oi ahahaha.

    In those cases. If they do skip a hotel (which I believe falls on estafa - I think), the passport is automatically held by authorities (police) upon apprehension since the hotel has no option but make legal actions... they are "guests" not tenants. There is no need for a hotel to withhold it, once it goes to police as part of personal effects.

    And depending on the client, hotels may or may not require security deposits (Credit card or cash), its not really that important for them, they are, after all, "guests"... the members of the "Continental Club" of the Marco Polo Plaza Hotel (A 5 star hotel - there are only two (2) 5 star hotels in Cebu - the other one is Shangrilla) are not even required the standard check-in procedure... all they have to do is produce their membership cards and can settle their balance at their convenience.

    Hoteliers will never require a guest to leave material articles as proof of guarantees... we find that rude, and I have never encountered a guest who still wanted to stay because he ran out of money and had no place to go... they had the courtesy to leave beforehand.

    So, I believe, YES, In the Hotel Industry... I only require photocopies... when in a Hotel.

    I was also a Concierge.

    All are duly noted also hence the nice exchange of knowledge here but if you can go back to page 3 and refer to reply number 40 , you will clearly see who is hostile . All my inputs were general information applicable just by anywhere else even outside the property business .

    The only people who can keep PASSPORTS ( original ) are immigration personnel for verification purposes on legal matters being FOREIGNERS .

    Back on AJOL .... the THREAD is not APPROPRIATE at all , before one can help someone , that someone needs to know firsthand to help himself / herself and most of all acknowledges that he or she needs help .

    I laid my cards in the table ie SECURITY DEPOSITS and ADVANCE RENT , I dont even know if it was duly noted since its the very basic form of leverage .
