You have to consider that even if you speak ill of a person or even criminals for that matter. It is a matter of speaking only.
What is important is due process.
Mind this because this is important.
One is not trampling over the Bill of Rights by mere allegations, accusations or utterances.

There is what we call the criminal due process, there is proper investigation and the accused (killer) has the right to defend himself.
And he has to be proven in court to have killed the victim.

It was a hyperbole that people always mistook and take in at face value.
