    wala... 23 lang sila senator, kelangan laing botohan for that vacant seat kay dili man sila (senators,opposition and admin) na kuhaon sa 13th spot iyang position.

    Kung kampante si Koko Pimentel na siya ang tunay na hinalal ng mga tao, then he shouldn't be afraid of special elections, or of the Comelec officials going to Maguindanao to personally investigate the alleged fraud. But he is the one who is doing his best so that the Maguindanao voters would be disenfranchised.

    Administration Team Unity (TU) candidate Juan Miguel Zubiri is emerging as the winner in the tabulation of votes in Maguindanao, dislodging Genuine Opposition (GO) bet Aquilino “Koko” Pimentel III for the last spot in the senatorial race.

    In the initial tallies by the special provincial board of canvassers yesterday, Zubiri garnered a total of 127,039 votes from 16 of the 22 towns of the province against Pimentel who only had 45,678.

    The Commission on Elections (Comelec) said the final results of yesterday’s canvassing here would not necessarily result in the proclamation of Zubiri as the 12th winning senator but was a step necessary to complete the process for the National Board of Canvassers (NBC).

    Comelec spokesman James Jimenez said it is a “ministerial” duty on the part of NBC to canvass the provincial COCs unless the Supreme Court allows the petition of Pimentel to stop the counting.

    Pimentel has asked the high tribunal to stop the canvassing, claiming the results of the elections in Maguindanao had been rigged to favor the administration’s Zubiri.

    Jimenez pointed out the Supreme Court has yet to deliberate on Pimentel’s petition with a prayer for a temporary restraining order (TRO).

    “From where I’m standing, the only thing that the Comelec can take to render the case moot is to actually proclaim the winner, one way or the other. So long as we are not proclaiming a winner, then the case remains good and it won’t be rendered moot,” Jimenez said.

    The Supreme Court will deliberate today on the petition filed by Pimentel seeking to stop the Comelec from counting the votes from Maguindanao which he claimed were already “compromised.”

    Pimentel insisted Comelec should exclude the votes from Maguindanao since they have been allegedly compromised after they were reported missing by provincial election supervisor Lintang Bedol.

    Bedol, who was the subject of a manhunt by the Comelec after disappearing for several days during the canvassing, said that among the missing poll documents are the COCs from the 22 towns and statements of votes from the province.

    Comelec finally recovered the “missing” COCs after it sent a team of commissioners headed by Abalos himself who received the copies of the returns from the election officials of each of the 22 towns in the province.

    Comelec said the copies of the returns only indicated that elections really took place in Maguindanao on May 14.

    Chief Justice Reynato Puno said they are hopeful that they would be able to come up with a decision today on Pimentel’s petition.

    “Hopefully, yes. I would ask the members of the court if after the hearing they are ready to resolve the prayer for the TRO... But we are hoping that they would give the SC all the reasonable time to resolve the request for a TRO,” he said.

    The high court had directed Zubiri to submit his comment on the petition of Pimentel for the oral arguments set at 2 p.m. today.

    But asked about the effect of the court’s decision after Comelec had already completed the recanvassing in Maguindanao, Puno replied: “We will cross the bridge when we reach it.”

    ‘Nerve wracking’

    Lawyer Emilio Santos said it has been a “nerve wracking” experience for him to preside over Maguindanao’s special provincial board of canvassers in recanvassing the votes from the province.

    This was the only answer Santos gave to reporters here while refusing to comment on the proceedings of the canvassing which started Monday.

    Santos said the results of the canvassing here would be presented before the NBC in Manila for final disposition.

    The canvassing was witnessed by representatives and lawyers from the opposition and administration.

    Zubiri’s lawyer George Erwin Garcia said only the NBC and the Supreme Court are the proper forums where questions arising from the canvassing in Maguindanao could be discussed.

    On the other hand, lawyer Pastor Primor, a representative of the Legal Network for Truthful Elections (LENTE) who had been critical of the conduct of the May 14 elections, said yesterday’s canvassing proceedings were “in order.”

    Maguindanao had been the hot spot of this year’s elections because the province is a known bailiwick of the administration.

    The opposition is praying to exclude the vote-rich province from the canvassing, a move which will solidify Pimentel’s lead over Zubiri who earlier trailed by only 120,000 votes.

    In the 2004 elections, Maguindanao gave President Arroyo the swing vote in Mindanao and gave the opposition presidential candidate and late actor Fernando Poe Jr. zero votes.

    The results of the May 14 elections in the province captured the attention of the public when 19 of the candidates received zero votes in all of the 22 towns.

    Pimentel claimed the voting phenomenon is “statistically improbable.”

    In the vote-rich Datu Piang town where Poe got zero votes in the 2004 presidential elections, Zubiri defeated Pimentel with an overwhelming vote lead.

    Datu Piang has 18,492 registered voters, mostly known for what seemed to be “canine loyalty” to Mayor Samer Uy and Maguindanao’s political patriarch Gov. Datu Andal Ampatuan.

    ^ This is the reason why Koko Pimentel won't accede to any other legal remedy to include the votes of the people of Maguindanao in the canvass of votes. Miguel Zubiri has the support of the Maguindanaoans and Koko knows that. Hence, he wants to exclude the votes from Maguindanao.

    His lawyers wanted to exclude a whole locality just so as to sustain Koko from the 12th spot. Such is a complete disenfranchisement of votes. At least, the votes from Maguindanao did not go into waste.

    bitaw sa... unsa na votes inyo gistoryahan, kadtong giwala sa tuta ni garci? wala jud tawn nawaste ang ila gihaguan ug tago na mga COCs... aw hinuon, wala pa man ta kalimut sa "yung dagdag!"

    no wonder, if and only if, maksulod si zubiri...
