    Default I need to know where I/we stand into this.


    We are working on a company where they said that they follow the 48 work hours as mandated by the DOLE. But since they don't want us to work 6 days straight, they only allow us 5 days of work with 2 days of rest days. Our schedule starts from 6:00 AM to 3:30 PM. this is 9 hours and 30 minutes, 1 hour for the lunch, 30 minutes for two 15 minutes break. These past months, they extended our works hours for 30 minutes which means that we are already working 8 hours and 30 minutes, (excluding the lunch and break). According to the Labor Code of the Philippines, an employee is allowed to work a maximum of 8 hours per day! If they will exceed on the 8 hour mark, the employee should be paid for the excess overtime work load. According to our company, we should not be paid because we are only allowed to work 5 days and it doesn't take up the whole 48 hours work load. This tiem, they also required us to be on time 15 minutes earlier before the start of our shift which is 6:00 am. Which means that we need to be in the office and stamped in around 5:45 am. Failure to do so will be tagged as late. This means that everyday we are working 8 hours and 45 minutes. We tried disputing in with our management but to no avail. When we reviewed the Labor code, we found out that the 48 hours work week is only applicable to resident physicians, nurses, nutritionists, dietitians, pharmacists, social workers, laboratory technicians, paramedical technicians, psychologists, midwives. I don't think being a customer service representative belongs to any in this criteria.

    During holidays, we have the options to choose to whether convert it to cash or to leave. As you can see we are only getting .5 leaves per month. 1 if we work on a holiday, but if we are going to take the leave, we are no longer entitled for holiday pay which I find strange.

    I have only been in this company for 2 years, and I come to love the people and my colleagues but this past months, I was planning to resign, and look for another one. I've been with better company before however I did take them for granted, and now when I wanted to really work for real this time, I ended up in this company.

    Any comments, suggestion or recomendation is helpful as I can advise my colleagues as well on where they stand on this. Thank you! More Power to Istoryans!

    For me, failure to arrive 15 mins before your time in is not marked as late because as what have u said na your work starts at 6am, So even if u arrived 5:58 its no considered late. Then extended working hours is considered overtime. In my previous company, our minimum overtime hour is 1 hour so if you extend be sure to complete the 1hour period otherwise it will not considered overtime. Besides you have to file manually for the overtime. In your case, you didn't mention if your overtime is manually file and also if you are using bundy clock for time-in-time-out.

    You didn't mention also what type of industry you are working with. but I think it's like manufacturing industry. Be sure to consult your HR regarding this matter. As what I have understand murag nilabag sila sa DOLE.

    ts , sa ako lang ha , okay ra na ang extra time ninyo sa inyong company di naman kaayo na excessive ts ,tan awa ubang companya nga tag as kaayo og oras ang mga trabahante unya gamay ra sweldo , if sa ako na nahimutangan i would not mind ...

    karon pa ko nga naa diay category ang mo render og 48 hours/week...
    paminaw nako naka lapas na jud na sa labor code ang inyong company og dapat inyo na jud nang e repost bsan mo resign pa ka pero louy ang imong mga kauban nga nahabilin....

    Pero depende mana bro what type of work sad imu g.sudlan. Labag gihapon sa Labor code.. gamay lang siya pero 30 mins time 5 days pwerte nana dakoa.

    I think I know asa ka trabaho and yes, disagree ko sa 15 minute earlier policy. ganahan cguro sila daghan mga term

    double pay for holiday is not credited when you applied for a leave on that day. dapat ga duty ka ana. 9 hours for 5 days jud dapat. kansi mo anang 30mins. nga mini break. hehe d ko sugot ana oi.

    hinuon, sa ako work karon, 12 hrs for 4 days, ni offer mig 3 hours sa company without pay. abi kay 3 days off. tsk tsk

    Paeta, wa ko kasabot og nganong render silage 48hrs/week kay sa uban cc kay 8 hours per day, 5 days/week. if mo lapas ka sa 8th hour considered as ot with pay na. sa amo ot ty man.

    ako duty starts at 5:45am mo end nig 4:00pm. imagina, wala nay OT pay

    akong pasabot bro, papilion ka if leave imo or double pay, mo work japon ka kay if mo pili ka sa leave imo VL ma dungangan og usa.

    Ts..i dont really see anything wrong ani ts.. sorry ha. If it happened to me, OK ra ko basta well compensated lang og naay mga benefits. if pasayohon ka og 15mins, pasabot ba ana work naka dayon? cguro pasabot nila ana kay ang uban mosulod og 6, but mo start og work kay 15 mins later... Nindot na kaayo nang 5 days a week oi..sauna work ko sa pinas..everyday paman gani ko work 2 shifts per day pako(Mon-friday start ko 6am uli ko 11PM, except saturday & sunday kay 1 shift ramn). naa hinooy ot pay but gamay kaayo & patyon ras Tax. molimpyo rako og 10K per month.. hinoon, lain-lain ta og trip ts. If tan-awn nimo di kaganahan sa patakaran, adto sa inyong HR.If dili jud nimo madala, then balhin nalng kaysa madaot imong bad record..hehe
