Dili mana ground for termination/end of contract ang lack of experience TS. Bawal mana ingnon lang ka lack of exp kay kng mao na rason maau pa wala ka gdawat in the first place. saons. report na sa DOLE. Dako2 ka makwarta ana if ever mdaug ka ana na caso. illegal dismissal.

Bro you don't need to know a certain company if they violated such labor code. For administrative expulsion there's a protocol in place such as first offense would be written warning, 2nd and 3rd offense would depend on company directives.
If a company just terminated you because of "lack of experience" obviously that's a lame stupid reason. Or let's say she's a poor performer at least the company will take initiative to help her why hire someone then tell that person that she/he lacks experience.... weird.
Also it's your right to fight because at times private business sectors are taking advantage of the ignorance.
Basing in TS statement it was clearly illegal dismissal.

the TS didnt even mention if she was a probi or a regular employee.
the reason why im asking what company she's working with is because if it's a small organization or business, there's a high chance she was terminated due to re-engineering,redundancy of positions, cost cutting and the likes. if it's a big/more structured company, it might be because she was not able to reach the metrics/standard they need blahblah.
let's say, if she's working as a business or QA analyst, and the other person she said has less experience but can actually think better, and the company just realized 1 QA/business analyst can do the workload alone, do you think they'd say "we prefer this employee coz she can think better than you or her IQ is way above than yours or you always commit mistakes, or you're always loading slow" i agree it's a stupid lame reason for the termination but it's over and it's the nicest reason they could think of. If it was me who axed her tenure, i'd tell her everything and explain why.
Regarding hiring poor performer, i believe no company can filter the best applicant during the hiring process that's why there's always assessment, appraisal, evaluations -monthly, quarterly, yearly etc. you can't blame an employer alone if the employee is not performing. the root cause doesnt always direct you to the employer. there are a gazillion reasons. this is also the reason why there's 5-6months probationary period.
if you have a company and you notice someone who's lazy, always tardy etc, would you be patient enough and spend additional resources? if the income of the business is more than enough, i'd probably give more incentives but performance is already the required task of an employee.
