    CEBU, Philippines - With government taking an iron fist in implementing the helmet law, the Department of Trade and Industry (DTI) is strictly monitoring the establishments selling protective motorcycle helmets to ensure the products are certified.

    During the Association of Government Information Officers (AGIO) forum yesterday, DTI Regional Director Arteria Caberte said it is mandatory for all manufacturers and importers of protective helmets and their visors to secure a Philippine Standard (PS) License or Import Commodity Clearance (ICC) certificate from DTI prior to the sale and distribution of their products.

    Caberte said enough time was given to manufacturers, importers and distributors to comply with the product certification scheme.

    So far, 21 helmet brands have been given clearance including HJC, Yamaha, Spyder, Index, AGV, XPOT, LS2, Posh, Zeus, Voltz, Powercycle/Transcycle, Zebra, AXA, Shoei, SOL, VCAN, Tankeo, LEV3, XPX, AM, and Yema.

    Caberte warned that persons or establishments found selling substandard motorcycle helmets or those without a PS mark or ICC certificate shall be fined not less than P3,000 for the first offense and P5,000 for the second offense.

    Tampering, alteration, forgery and imitation of PS mark and/or ICC certificate in the helmets is punishable with a fine of not less than P10,000 but not more than P20,000 without prejudice to other penalties imposed under Republic Aact 7394 or the “Consumer Act of the Philippines.”

    To ensure compliance of the law, Caberte urged the public to patronize only PS and ICC-marked products.

    Land Transportation Office (LTO) Regional Director Raul Aguilos also said no one is exempted from Republic Act 10054, which mandates all motorcycle riders to wear standard protective head gears while on the road. The law will be fully implemented starting July 30.

    Section 5 of RA 10054 states that the helmet shall bear the Philippine Standard mark or Import Commodity Clearance of the Bureau of Product Standards and complies with the standards set by the BPS.

    Aguilos, on the other hand, said that the full force of the law will be enforced, with provisions of first violation with a fine of P1,500; P3,000 for the second offense; P5,000 for the third offense, and P10,000 for the fourth offense plus a recommendation for the revocation of the driver’s license.

    Aguilos stressed that non-wearing of helmets is equivalent to wearing of helmets that are not complying with the standards.

    In addition, DTI were able to accredit 87 brands of helmet as of December 2012...

    QUICK FACTS ABOUT ICC:

    LTO at DOTC lang ang pwedeng manita. Pag pulis: hanapan ng Mission Order. Pag traffic enforcer, Ordinance.

    Hindi kailangan ng papel, sticker lang sapat na.

    Hindi kailangang 2012 ang sticker, basta authentic.

    Pag nag-insist, magpa-ticket at ipasulat ang SPECIFIC violation, lagyan ng for contest.

    How about Cebu set a good example to other cities. If they would follow and implement, then good! But if not, Cebu should not say we will not implement because they are not implementing. Irregardless of what other cities are doing, Cebu should set its high standards of Traffic Discipline. Cebi is after all a worldclass city

    dapat ang mga distributor selling substandard helmets will be fined Php 3000 per helmet found in the store and in the stock room para ma tagam ... kay sila maoy reason ngano daghan tao mga na hasol kay nag tuo ta ang ato helmet gi palit standard!
