The Business Name Law or act No. 3883, as Amended by Act No. 41476 and R.A. No. 863..."business names that are not acceptable include those that are identical to business names already registered with the Department of Trade and Industry, the Securities and Exchange Commission (SEC), Cooperative Development Agency (CDA), Department of Labor and Employment (DOLE) or other government office authorized by law to register names."
simply means: SEC/CDA/DOLE registered business names (meaning corporations, cooperatives, associations) cannot be registered with DTI... so DTI (sole proprietor) and SEC (corporation) registered names cannot be the same, as provided by law.
ma kwartahan ra nya ta ani puhon)) ahahaha
Pare...misleading ni...You can use the same SEC registered name as your DTI Business name provided you are the same entity...
What is prohibited is another person/ entity using an already registered SEC/ DTI trade name...
Illustration
ABC Food Corp. is SEC registered and they registered their DTI Business name as ABC Food Corp.-- this is allowed
ABC Food Corp. is SEC registered they registered their DTI Business name as ABC Foods -- this is allowed
ABC Food Corp. is SEC registered they registered their DTI business name as ABC Fastfoods (which is already registered by ABC Fastfoods Corp.)--this is not allowed...
The ratio why the Business name law was passed was to regulate registration of business names and to avoid confusion and misconception in the minds of the consumers/ public at large
Read the whole law in its entirety...![]()
