Enrile quizzes defense, prosecution on 'culpa'

“What is culpa?” Enrile asked the two parties.
Lead defense counsel Serafin Cuevas, who seemed unsure of his answer, said, “Maybe I was absent when it was discussed in school.”

“That's your bad luck,” Enrile replied.

Prosecutor Ilocos Norte Rep. Rudy Farinas stepped in and answered that culpa is a “willful and intentional violation” of the law.

The senate president sitting as presiding officer pointed out that “culpa” is material in considering the Constitutional provision requiring the truthful disclosure of statement of assets, liabilities and net worth.

“If complete SALN declaration is a command, does disobedience to it constitute a culpable violation?

The defense team has insisted that Chief Justice Renato Corona, who is accused of untruthful disclosure of his SALNs, acted on “good faith” when he did not declare his dollar accounts.
The defense said Corona merely relied on the absolute confidentiality guaranteed by laws on banking secrecy and foreign currency deposit units, and was not trying to hide his assets. Enrile, however, said depositors can voluntarily disclose their dollar accounts without suffering from penalty.

“What injury will be caused if a public officer with foreign currency deposits would declare that deposit in his SALN?
“We are forgetting that the law allows exposure of foreign currency deposits if the depositor himself would do it,” he said.
Enrile added that third parties, such as banking institutions, are the ones prohibited to reveal foreign currency deposits and not the depositors.

But Cuevas said declaring dollar deposits may put government official at risk of kidnapping or extortion... wheeeeiiy!!

Conclusion: If the Senator-Judges got JPE's interpellation of Cuevas we can expect a unanimous or overwhelming vote of guilty.

depositor of a foreign currency deposit to be permitted not to include his foreign currency deposits in his SALN if he is a public
officer or a public employee?
Cuevas – the probability of kidnapping, extortion and so on, especially with the trend of criminality today.

Enrile – was that contemplated by the laws? Related to this first question of mine, will a public officer or employee who maintains
a foreign currency deposit incur the punitive penalty of RA 6426 if he would reflect that deposit in his SALN?
Cuevas- I do not see that probability but it would amount to a vitiated consent

Enrile – you are forgetting that the law allows the exposure of a FCDU by express provision of RA 6426 if the depositor himself
would do it. There’s no secrecy law in this country that prohibits, or inhibits or proscribes the depositor from revealing his own
deposits. What is prohibited is for third parties to reveal it. Therefore they are penalized. But the depositor is not.

Enrile – do you consider that sentence as a mandatory provision that requires to be obeyed by a public officer/employee of the
PH? A public officer or employee, shall, upon assumption of office and as often thereafter as may be provideed by law, submit a
declaration under oath of his assets, liabilities and net worth. Do you consider that command of the people or was it something
that can be disregarded?
Cuevas – I don’t think it must be something disregarded. But there are rights of the depositor that arises from a different law.

Enrile – if this is a sovereign command, will disobedience of this command constitute a culpable violation of the Consitution?
Cuevas – I would not … unless that facts are known to me.

Enrile – I’m sure all of us graduates of UP College of Law went through roman law. What is culpa?
Cuevas – intentional

Enrile – No. There are four kinds of culpa… We’ll go to elementary school book in roman law. What is culpa?
Cuevas – I’m not in a very good position to recall. Maybe I was absent when it was taken.

Enrile – Maybe that’s your bad luck. What is the difference between culpa and dolus?
Cuevas – maybe negligence.

I rather hate Farinas for his mga palusot.. ang question why he allow ang palusot, if he had doubts on his mind then he should had confront Corona while he is on the hotseat. you cant blame Manalo for being defensive that his job while the burden of proof lies to the prosecutors and they didnt capitalize.

Bright pud ni si Manalo, he was still composing his final arguments while Farinas making his speech. Actually nice move ni sa defense one of them made a very detailed speech, manalo made a confrontational speech and cuevas made a semi-impromptu speech.
