Kung nahitabo kaha nga papasohon sila, unsa kaha mahitabo sa graduation rites? Naa ba kaya'y mga students/etc. nga pumakpak kanila? Naa ba kaya'y mang-boo kanila? Naa ba kaya'y mang-insulto kanila? Or naa'y mag-walk out?

    Unsa kaha no?

@ReikoChan, thanks for the link. Dako jud ang pangutana, kanus-a na-serve ang TRO.

kuyawa gd diay ug technique aning stc.. bisag naa nay TRO i guess they will do everything para di lang jud mka paso ang kadtong students.. hinoon sad, naa jud silay stand sa about sa ilang law sa ilang school, but by doing such thing wise jud kaau sila. feel nko bisag kinsa pa tingali mo order nga papasohon ang studyante, kay mangita jud ni sila ug way nga ma impose jud ilang sanction. although sala jud sa mga students, but in my own point of view, they're doing dirty tactics in a legal way. nice move sad. hahaha opinion ra sad nko.

bitaw bro sakto jud ka, para nko sad dapat nalang jud tunlon nalang jud ang garbo.. alangan naman sad molabaw pa sila sa supreme court.. with what they've done about the TRO, it's like they're showing us that you can argue and not to follow a court order if you think it is wrong.. nothing is above the law jud as what i have seen from the comments from sunstar news

Pero basin naa pa gyud technicalities involved... STC is a privately run school, for instance. So I believe outside intervention is only necessary when STC is, without a doubt, breaking the law. Personally, I do not agree with the issuance of the TRO under the circumstances and available evidence. And I did not see anything wrong with the sanctions they gave to the 5 students. Probably why STC is questioning the TRO by filing the reconsideration. Pero... in the end, unsaon taman. Korte naman.

    Pangutana:
What are the prerequisites before the court can issue temporary restraining orders? Does this mean every time a student is denied graduation mudagan nalang ta ni Mr. Judge unya magpa-issue ug TRO? On what basis exactly? Diba only when the school is acting unlawfully? Did STC violate the law by denying the students graduation rites?

He says that STC made use of technicality strategies by being "unreachable" to the sheriffs that carried the order. They did this by barring anyone without an "invitation" from entering the school. He says that the same process goes for other orders like, say, subpoenas. If they can't reach the person in question (say, he's not at home) on the first try, then they will have to come back the next day and try again, until they finally present the order to the person in question. Unless this is done, that order is still not effective, he says. "What STC did was technically legal. Dirty, maybe, but still legal," he says.

    How true is this?
w0w.. never thought of this.. Nindota diay ani sah, mura man sad ug trial ni cj corona daghan kaau technicalities manggawas.. hmmm.. hope someone might be able to answer this one with technicalities also.

Well if the TRO has not yet been served yet does it mean it has still no effect?

If this was the case I would say this was a brilliant counter move from the STC lawyer. Kudos to him.

I know. The man I spoke to was my father. He was subpoena'd once, and due to the nature of his profession, the sheriff's weren't able to reach him at once. We are both not sure whether the same thing applies to TRO's though (he's no lawyer), but it's possible.

Nawala man atong student lawyer oi.

Maapil ba ka contempt ana ang lawyer if in case sayop iya pag interpret? Kung wala man gali indepth nga hearing mahitabo during sa TRO, dapat lang jud tingali naa jud bond para at least mao man na bayad pud sa damages if masabtan nga sakto ang pikas (in this case STC) Kay d ba both sides still has to give their evidences, what if mapamatud-an nga sakto ang STC then nakapaso na ang students, wala nay ipahamtang nga silot kay naka paso naman.
