First, the problem of determining obscenity. The censors must think that what they see as smut is smut. Wrong. Community standards, or "aggregate sense of the community," must be determined by the court, not the censors.
Second, the censors hold no power of censorship, which was abolished by the Constitution's guarantee of free speech. A CCAIB member's offer to read before publication "From Junquera with Love" in Superbalita and "Wildflower" in Banat News is totally shocking. A provision in the proposed ordinance equating tabloid with sleaze is ignorant stereotyping.
Third, legislators apparently believe in prior restraint, which is a no-no in free and democratic society, and confiscation of property on the say-so of the moral arbiters, which violates due process.
Fourth, they see tabloids as contraband, meaning illegal and unlawful by mere display or possession, something like marijuana, shabu, coke, or illegal firearm. They think they can seize tabloids from newsstands just as authorities can confiscate contraband anywhere.
