I'm talking about the application of "the rule of law" not the composition itself. You're right it is a covenant between government and people. But, this is a democracy, where there is no real "sovereign" but the people itself--the officials we elect have the authority, but that authority is limited within the constitution, and must be used for the benefit of the people. The constitution is above everyone, the president, the other officials, the constituents--nobody is above it. All three branches MUST act in the interest of justice and the good of its constituents GIVEN that this act abides to the constitution. The constitution in the Philippine context is ultimate--it applies to everyone of citizenship and allegiance to the country, unless formally charged with inconsistencies with the law or under the custody of law--in which case the rights ensured in the constitution are determined only by the State.

Oh well, let the trials begin. Hopefully, if there is any consolation for the curtailment of the constitution it would be TRUTH. The world's tuned in.

Have you read sir the dissenting opinion of Justice Serano? Before you talk about the constitution and the right to travel read it first .
The government as a representative of the people- the sovereign- should be given an opportunity to be heard also. The SC did grave injustice to allow the TRO without also giving chance to the government to be heard.
The SC did not rule on the orders constitutionality, nor the right of Arroyo to travel. LOL. But all this is moot and academic isnt it?
