There are many countries that refuse to sign an extradition treaty with the Philippines because they have no confidence in our justice system and believe that extradition may be used to drag their innocent citizens and subject them to a system of justice that is tainted by corruption. I can't say I blame them...

The Philippines has extradition treaties with Indonesia (1976), Australia (198, Canada (1989), Switzerland (1989), Micronesia (1990) the United States (1994), Hong Kong and South Korea. All these treaties follow the "non-list" type of double criminality (crime applicable in both countries) approach, where there is no traditional listing of crimes, as this could lead to difficulties where the countries denominate crimes differently.

In refusing to issue an ADO to Arroyo, De Lima pointed out that most of the countries the congresswoman was planning to visit had no extradition treaty with the Philippines.
But Santiago downplayed the issue of extradition, saying the absence of which would not necessarily prevent the Philippine government from going after a fugitive from justice or a person with a pending case.
“If the applicant is accused of a non-bailable offense and there is no extradition treaty between her state of destination and the Philippines, her mere failure to return might result in a defeat of justice, but it will not be a threat to national security,” she said.
Santiago described an extradition treaty as a contract between nations to turn over a wanted person staying in the other state’s jurisdiction.
“It is not so simple to argue that if the applicant goes to a country that has no extradition treaty with the Philippines, there is no way of getting her back,” she said.
“The matter of extradition can be either contractual or political. This means that even if we have no extradition treaty with another country, if that country wants to extradite the applicant, there is no rule in international law that prohibits a country from extraditing a foreign national as an exercise of state sovereignty.”
“It’s not difficult to get a Filipino, unless, of course, there is an existing conflict between the Philippines and the other country, if the relationship is bad,” she said. “But otherwise, I don’t know what the big fuss is all about.”

When Miriam said contractual it probably means under a treaty, when she said Political that means we dont necessary need a treaty just the other state's cooperation to surrender the person to the Philippine government. Let us underline the word "conflict" or the "relationship is bad" I hope you understand international politics most states dont care to do what the other states want such as surrender someone unless there is something it for them. Furthermore some states are very stringent in surrendering other people because they think that person's right will be violated.

IF THAT COUNTRY WANTS TO coupled with "there is no rule that prohibits". She's being disingenuous here, its not that there is no rule that prohibits non-treaty countries from extraditing, but the fact that if there is no treaty, nothing at all can compel these countries from doing so. Which simply means, they won't!
