The Philippines has extradition treaties with Indonesia (1976), Australia (198, Canada (1989), Switzerland (1989), Micronesia (1990) the United States (1994), Hong Kong and South Korea. All these treaties follow the "non-list" type of double criminality (crime applicable in both countries) approach, where there is no traditional listing of crimes, as this could lead to difficulties where the countries denominate crimes differently.

Consider it like this, in that way, you will understand.

You have a Rolls Royce Phantom. You blew up the engine. Sure, you can fly certified RR mechanics to repair your car, but the equipment needed to repair is only available in the UK. You love you car. What do you do? Leave it that way, or have it shipped to the UK for repairs?

A lot of people who are SICK don't look healthy. You think she's faking this illness?

All this namby pamby wishy washy thing of not letting her go is a publicity stunt.

If GMA dies on PNOY's watch, tsk tsk. I wonder about the consequences ................

In refusing to issue an ADO to Arroyo, De Lima pointed out that most of the countries the congresswoman was planning to visit had no extradition treaty with the Philippines.
But Santiago downplayed the issue of extradition, saying the absence of which would not necessarily prevent the Philippine government from going after a fugitive from justice or a person with a pending case.
“If the applicant is accused of a non-bailable offense and there is no extradition treaty between her state of destination and the Philippines, her mere failure to return might result in a defeat of justice, but it will not be a threat to national security,” she said.
Santiago described an extradition treaty as a contract between nations to turn over a wanted person staying in the other state’s jurisdiction.
“It is not so simple to argue that if the applicant goes to a country that has no extradition treaty with the Philippines, there is no way of getting her back,” she said.
“The matter of extradition can be either contractual or political. This means that even if we have no extradition treaty with another country, if that country wants to extradite the applicant, there is no rule in international law that prohibits a country from extraditing a foreign national as an exercise of state sovereignty.”
“It’s not difficult to get a Filipino, unless, of course, there is an existing conflict between the Philippines and the other country, if the relationship is bad,” she said. “But otherwise, I don’t know what the big fuss is all about.”
When Miriam said contractual it probably means under a treaty, when she said Political that means we dont necessary need a treaty just the other state's cooperation to surrender the person to the Philippine government. Let us underline the word "conflict" or the "relationship is bad" I hope you understand international politics most states dont care to do what the other states want such as surrender someone unless there is something it for them. Furthermore some states are very stringent in surrendering other people because they think that person's right will be violated.

As much as I admire Defensor I would like to disgree with her. I think I can decide on my own.

I think Santiago is engaging in a bit of doublespeak there, who knows what her intentions are but anyone with a keen sense of what she's saying knows what I'm talking about.

"if that country wants to extradite the applicant, there is no rule in international law that prohibits"

IF THAT COUNTRY WANTS TO coupled with "there is no rule that prohibits". She's being disingenuous here, its not that there is no rule that prohibits non-treaty countries from extraditing, but the fact that if there is no treaty, nothing at all can compel these countries from doing so. Which simply means, they won't!

"“It’s not difficult to get a Filipino"

What she really means is its not difficult to get an ordinary Filipino, not one with the vast resources and connections that an ex-President does. Also notice her choice of words, she says "not difficult" she didn't say it would be easy. I mean geez - she's saying our only option would be a political one. Uh.. is this the same woman who deluded herself into thinking the Philippines is more powerful than Hong Kong because HK is only a province of China? What kind of political pressure are we gonna apply on even an ASEAN country? We can't even get Vietnam to stop building watchtowers in our own land. What's this woman smoking..

Lastly "I don’t know what the big fuss is all about.” Lol.. that made me laugh. If you really believe she doesn't know what the fuss is all about, then ...

Ill tell them to send me the engine and the equipment and the best team of mechanic they have and fix it here.

Too much shipping will damage the rolls.

LOL. We no longer in the 18th century that we can reason its only available there. LOL. in the case of Arroyo its not even about the engine but the mechanic.

    So correct your analogy first.

OK. Since Y'all are not keen on letting her leave, let's just see what happens. If she dies on PNOY's watch, then the consequences are going to be catastrophic.

    Just hope she lives.
