    De Lima’s poll fraud body railroads raps vs Arroyos

    Racing against the clock to meet the deadline President Aquino had earlier set for former president Gloria Arroyo and her husband to be charged for crimes this month of November and jailed before Christmas, the panel of lawyers picked by Justice Chief Leila de Lima from her Department of Justice (DoJ) and the Commission on Elections (Comelec), evidently obeying orders from Malacañang, yesterday denied all motions submitted by the defense panels, and clearly railroaded the preliminary investigation involving the former president, her spouse, Jose Miguel “Mike” Arroyo and several others, including former poll chairman Benjamin Abalos Sr., to meet Aquino’s deadline.

    With unprecedented haste, the panel of lawyers from the DoJ and the Comelec yesterday said it has heard enough from the defense panel and will now proceed to resolve the electoral sabotage case filed against Mrs. Arroyo, her husband and others the panel had implicated in the electoral sabotage case, a crime that is a non-bailable offense.

    The joint panel investigating the alleged 2007 electoral fraud in its second hearing declared the case as submitted for resolution even as the panel denied all pending motions from the defense, including one requesting for more details of the case.

    The development prompted lawyers of the Arroyo couple to denounce the undue haste in the panel’s decision.

    House won’t protect Arroyo from arrest

    Congressional leaders say immunity from arrest does not apply to plunder and rule out taking custody of the former President

    THE HOUSE will not stop the arrest of former President and now Pampanga Rep. Gloria Arroyo because her parliamentary immunity does not protect her from high crimes such as plunder and election fraud, House Speaker Feliciano Belmonte Jr. and House Majority Leader Neptali Gonzales II said Sunday.

    “For offenses with penalty not exceeding six years in prison, immunity from arrest cannot be applied,” Belmonte told the Manila Standard.

    “The House cannot do anything” even if Congress resumed session Monday, Gonzales said.

    “Under the Constitution, no member of Congress can be arrested for a crime penalized by not more than six years. If it’s plunder, there is no immunity from arrest.”

    Belmonte and Gonzales said the House could not offer to take custody of the ex-President—a privilege extended to the so-called Batasan 5 in February 2006, when they quit Mrs. Arroyo’s administration—even if Arroyo’s medical condition was delicate.

    “That would be difficult,” Gonzales said.

    The Batasan 5—Bayan Muna Rep. Teddy Casiño, then Bayan Muna Rep. Satur Ocampo, Anakpawis Rep. Rafael Mariano, then Bayan Muna Rep. Joel Birador, and then Gabriela Rep. Liza Maza—made the House their home for 71 days. They were housed in the Speaker’s ante-room and their families got to see them on weekends or during session.

    The late Anakpawis Rep. Crispin Beltran was not able to escape arrest and was held by authorities, prompting the five others to seek sanctuary in the House.

    Now Casiño wants Arroyo jailed for plunder for her alleged involvement in the aborted $329-million NBN-ZTE deal.

    Bayan Muna was behind the plunder case that President Benigno Aquino III used to justify his decision to bar Arroyo from leaving the country to seek medical treatment for her spinal condition.

    The Arroyo camp, through its spokeswoman Maria Elena Bautista-Horn, expressed fears that the Aquino administration was rushing the filing of the charges in court so the warrants against her could be secured to permanently prevent her from seeking medical treatment abroad.

    The President has admitted that the cases are still under the preliminary investigation before the Ombudsman, and that Arroyo has yet to be indicted.

    Casiño on Sunday urged the House leadership not to place Arroyo under its custody.

    “Arroyo cannot invoke our case. Our case then was unique,” Casiño told the Manila Standard.

    “Arroyo declared a national emergency and she accused us of rebellion and conspiracy to topple her government, and we were wanted for arrest even if there were no warrants of arrest issued against us, so the House then granted our request for sanctuary.”

    Gonzales said Arroyo could be held under house arrest for humanitarian reasons, but that was up to the courts to decide.

    MANILA, Philippines - The camp of former First Gentleman Jose Miguel Arroyo has asked with urgency the Supreme Court to issue a halt order against a joint government committee, which terminated on Monday a probe into an electoral sabotage case.

    Arroyo, through lawyer Ferdinand Topacio, reiterated a plea on Friday seeking to nullify the creation of the joint Department of Justice-Commission on Elections committee that investigated his links to the allegedly fraudulent 2007 elections.

    He said it is clear from the petition “that this action was commenced precisely to seek the most immediate and speediest redress from this Honorable Court against the rushing, yet unconstitutional and gravely abusive [committee].”

    Arroyo presented news clippings as proof of the allegedly “persecutory manner” of the committee, “made obvious by the repeated prejudgments of guilt publicly made by no less than the heads of the committee, the spokespersons of Malacanang, and the President of this Republic himself who controls the DOJ.”

    He also noted the “mysterious resolve” of the joint committee of refusing to furnish him, despite repeated requests and follow-ups, of official and certified true copies of the joint order and rules of procedure.

    This includes the so-called “Initial Report of the Joint DOJ-COMELEC Fact Finding Team on the alleged Electoral Fraud and Manipulation of Election Results during the 2004 and 2007 National Elections.”

    He also noted he and the other respondents were only given 11 days to submit their counter-affidavits to the committee.

    He said all these prove that the committee is “a sham, hastily pursued to ensure…imprisonment with the least resistance and delay possible.”

    In a separate statement, Topacio also hit the allegedly “disingenuous and clearly observable intent to preempt the Supreme Court and render moot any decision in the Petition filed by the former First Gentleman questioning the legality of the Joint Committee, by denying our Motion to Defer Proceedings precisely on the ground of a pending serious constitutional question.”
