SC could decide on Arroyo petitions tomorrow

MANILA, Philippines - Supreme Court Spokesman Midas Marquez on Wednesday said the two petitions filed by former President Gloria Arroyo and her husband, Mike, seeking temporary restraining orders (TRO) on the watchlist order against them will be raffled today.

Marquez said there is a possibility a decision on the matter may be released as early as tomorrow depending on the preliminary study of the justice in charge.

"If the members of raffle committee are here...and the justice in charge is able to study right away, they can recommend issuance of TRO," he said.

The Arroyo couple has filed separate petitions asking the SC to issue stay orders on the watchlist order issued against them by the Department of Justice. The petitions also questioned the constitutionality of Department Circular(DC) No. 41 which grants the Secretary of Justice the power to issue WLOs and hold departure orders(HDO).

Justice Secretary Leila de Lima earlier rejected the Arroyo couple's request for allow departure order, saying there is no compelling reason for them to leave the country.

The former President earlier said she needs to travel abroad to get treatment for cervical spondylosis and hypoparathyroidism.

Her spokeswoman, Elena Bautista-Horn, said Arroyo wants to go to Spain where there are many bone mineral experts.

She also dismissed suggestions to invite foreign doctors to come to the Philippines instead, noting that it would be difficult for the doctors to take a 4-day leave just to treat the ex-President.

"To get a one-hour appointment ang tagal bago ma-approve, eto pang kukunin namin sila for 4 days. Even if pumunta yun mga doctors dito, wala nga po yun facility to do the protocols here," she told ANC's Headstart.
Meanwhile, Sen. Francis Escudero said the DOJ's decision to deny Arroyo's request to leave the country is illegal.

Escudero, a member of the Judicial and Bar Council, said only a hold-departure order issued by the courts can prevent the former President from travelling abroad.

The senator said he supports a bill in Congress that will give the Bureau of Immigration chief the power to issue a watchlist order good only for 10 days to give prosecutors enough time to seek a hold-departure order from the courts.

now its on the hands of the supreme court to decide.

Mike Arroyo: Aquino gov't 'a bunch of schoolyard bullies'

MANILA, Philippines - Former First Gentleman Jose Miguel Arroyo on Wednesday said officials of the Aquino administration were acting like a bunch of schoolyard bullies for rejecting former President Gloria Macapagal Arroyo's request to travel abroad for medical treatment.

In a statement issued by his spokesman, Ferdinand Topacio, Mr. Arroyo said the Aquino administration has no platform of government "aside from exacting street vengeance for perceived wrongs while running roughshod over legal processes designed to prevent governmental excesses."

Arroyo pointed out that even President Aquino's closest allies have opposed the President's position to exercise executive power over civil and political rights as guaranteed in the Bill of Rights of the Constitution.

"The Bill of Rights is supposed to be an island of entitlements into which governmental powers cannot intrude except for the most compelling of reasons. And the Constitution is a document for all persons for all times, irrespective of political exigencies. That is the underlying philosophy of a republican and democratic government. Unfortunately for all Filipinos, that concept appears to be far beyond the President's powers of comprehension," he said.

The former first gentleman said he is now placing their fate in the hands of the Supreme Court after he and the former President urged the Court to issue a temporary restraining order on the Department of Justice's watchlist order against them.

Justice Secretary Leila de Lima earlier rejected Arroyo's request to seek medical treatment abroad, a decision that she said was supported by no less than President Benigno Aquino III.

In a press conference, de Lima said the submissions and requests forwarded to her by the camp of Arroyo “puts to suspicion” that her illness is life-threatening.

actually it is the game that the palace wants to play..they know for sure that it is illegal.and for sure the arroyo''s would go to sc for this matter. Ug sama sa g sulti ni Ecsudero nga kining gibuhat ni delima illegal, and kay lage illegal man so naa possibility mga mo mo issue ug TRO ang SC againts sa watchlist order issued by Justice Secretary Leila de Lima ..now kay lage inyo man na g accuse ang SC nga favor sa mga arroyo so natural lang na nga masuko mo sa SC kugn ogaling mo issue jud ang SC ug TRO..diba? ..simple logic lang naman na..
