Tinuod nga ang adultery can only be committed by a wife. Pero wala na nagpasabot nga dili i-apil og silot ang lalaki nga iyang kabit. Same ra na sila og silot. Dili pud pwede nga ang wife ra ang kasuhan, automatic apil gyud ang lalaki nga kabit.

Take note nga pirming duha ka tawo ang guilty sa kasong adultery: the married woman AND the man who have s3xual intercourse with her.

Kun atong kwentahon, mas bug-at ang tulubagon sa lalaki kay mahimo man siyang ma-sentensyahan og adultery bisan dili siya minyo (basta ang iyang kabit nga babaye minyo).

Like sa babaye, they will charged for committing ADULTERY if and only if enough proof,evidence and supporting documents are to be presented by the husband, and if proven guilty,he should as well charge the paramour. In the same way, a wife must file the case for CONCUBINAGE against her husband and his mistress, she cannot charge the mistress alone.The only difference between adultery and concubinage is the process undergone in filing the case. As for concubinage,several grounds are to be considered,such as keeping a mistress in the conjugal dwelling; or by having s3xual intercourse under scandalous circumstances with a woman who is not his wife; or by cohabiting with his mistress in any other place.But since concubinage is difficult to prove in court, the wife should instead file a case of psychological violence under RA 9262 which includes intimidation, harassment and threats for a penalty of 6 -12 years imprisonment and would possibly be given the maximum penalty of 12 years if and only if the violence was committed against the woman when she is pregnant or in the presence of their children.While as for adultery maximum penalty would only be up to 6 years imprisonment.But if Psychological violence is not to be filed against and would be proven guilty for concubinage then the maximum penalty for the accused would only be 4 years imprisonment.
