    Graft, tax-evasion charges filed vs BOC employee, 2 rice importers

    A Customs employee was charged with graft on Thursday, while a rice importer and a licensed accountant were named respondents in a tax-evasion case in two separate charge sheets filed by the Bureau of Internal Revenue (BIR) and the Bureau of Customs (BOC).



    Bureau of Custom’s Paulino Elevado IV is facing criminal and administrative charges after allegedly soliciting bribe money from an importer. On the other hand, the BIR filed tax-evasion cases against a rice importer and an accountant.


    Gerardo Teves, a rice importer who owns Manila-based GT Trading’s Rice Importation, was found to have brought in 16 shipments of rice from May to July 2009, with values ranging from P310,768.01 to P26.7 million


    On the other hand, Emilino Maestro, a licensed accountant, was found to have tax deficiencies amounting to P6.78 million, including surcharge and interest. His income tax deficiency was P5.17 million and his value-added tax (VAT) deficiency was P1.61 million, the BIR said.


    Flor Tagle, an import and export consultant for Prima Modas Inc., in her four-page complaint filed with the Office of the Ombudsman, claimed that Elevado denied the entry of Prima Modas’s shipment from China in March despite favorable endorsement from the Office of the Commissioner.


    Tagle claimed that the shipment contained gummed paper, hair accessories and men’s slippers, among others, that has passed inspection conducted by the Customs’ Run After The Smugglers program, and was cleared for release on March 28.


    “When our papers were forwarded to the Office of the District Collector, Port of Manila, a certain Paulino Elevado met me in his office in said port and informed us that before our entry papers could get the endorsement of the district collector, we were required to give P200,000 or P100,000 without the snacks,” the complaint said.


    Tagle sought the help of now Transportation Secretary Manuel Roxas II, who immediately referred her to the Department of Finance’s Revenue Integrity Protection Service.


    RIPS conducted an investigation and found probable cause to charge Elevado “for trying to extort the sum of P200,000 in exchange for the signature of the district collector of Port of Manila.”


    Meanwhile, in the BIR complaint filed before the Department of Justice, Internal Revenue Commissioner Kim Henares said that National Food Authority documents showed GT Trading’s importations from the May to July 2009 totaled P98.99 million.


    However, Teves only declared P97,102.50 as GT Trading’s shipments during the period and having no inventory at the end of the year, suggesting that all the imported rice was sold.


    Based on NFA import data, Teves misdeclared his sales by P310.26 million, the BIR said. It noted that Teves’s total tax liability totaled P136.07 million, including interest and surcharges equivalent to P129.95 million from income tax and P6.12 million from VAT.


    The BIR also said Maestro, in 2007, filed a tentative annual income-tax return with no entries despite having filed quarterly VAT returns for the four quarters of the same year, with output taxes totaling P669,672.72, the bureau claimed.


    The BIR said “… it is clear that the said blank return is a false return with the intent to evade taxes.”
