    This confirms my personal experience that in some areas, like Customs or the BIR corruption has become worse and the amounts being asked for has increased under this admin.

    Consolacion Mayor defends husband accused of tax evasion

    THE Bureau of Internal Revenue (BIR) charged Nilo Alegado, husband of Consolacion Mayor Teresa Alegado, with tax evasion before the Department of Justice (DOJ).

    Nilo is facing a P102.4-million case, the amount he allegedly did not declare.

    BIR Commissioner Kim Henares was quoted in a Manila Bulletin article that Nilo, a rice importer, failed to declare accurate information on his income tax return (ITR) for 2009.

    Mayor Alegado yesterday said that while she already divested her interest in their rice business, which is located at the Consolacion Public Market, she knows Nilo has been paying taxes on the rice importation.

    “Had the BIR officials called us to explain the importation during their alleged investigation, we can surely present the BIR receipts as proof that my husband paid taxes. We are sure we can show proof that we paid taxes. But the damaged has been done because my husband has already been maligned by the filing of this case,” the mayor said.

    She said her husband did not receive a single letter from the BIR, informing him that he was under investigation for tax evasion.

    “The BIR officials who prepared the case and filed it are really unfair to my husband. In our 31 years in the rice business, we have religiously paid taxes. The BIR personnel in Cebu can attest that our records are clean,” she said.

    She said they are able to import rice because they comply with all government requirements.

    “Our bookkeepers and accountant are the ones who prepare the documents for payments of taxes because we trust them,” she added.

    Atty. Neri Yu, the chief of the legal division of the BIR 13, told Sun.Star Cebu that the case against Nilo did not pass his office because this was handled by the Run After Tax Evaders, the BIR’s tax collection scheme.

    In the same Manila Bulletin article, Henares was quoted as saying that Nilo imported rice worth P183.01 million in 2009, but only declared P3.41 million on his ITR and audited financial statements, based on records the bureau obtained from the National Food Authority.

    Under the Tax Code, an underdeclaration of taxable sales of more than 30 percent is considered substantial underdeclaration and constitutes prima facie evidence of fraud tantamount to tax evasion.

    Henares was quoted as saying the BIR investigators saw a discrepancy of P179.60 million between Nilo’s declared income and the real income it made from the rice importation in 2009.

    “Adding the declared sales of Mr. Alegado in his ITR of P4.33 million, sales should have been P183.94 million. The total percentage of underdeclaration of sales per investigation is 4,143.34 percent,” Henares said in the Manila Bulletin article.

    He said Marubeni would be pouring in more capital for the expansion of the capacities of its Pagbilao and Sual coal-fired power facilities.


    “They are looking at expanding the capacities of Pagbilao and Sual. Talks are ongoing because they are also discussing the possibility of increasing the expansion. They are thinking, if they would expand further the 400-megawatt Pagbilao capacity to 600 MW,” he said.

    The usual divide and rule path


    The divide and rule tack of Noynoy’s yellow appointees at the state-owned Development Bank of the Philippines (DBP) is working perfectly, which may be enough to destroy the global reputation of the bank.

    The DBP is the government’s premier commercial bank which, along with the Land Bank of the Philippines (Landbank), that in turn was created to supposedly serve the vast agricultural sector, was designed as tools for the country’s development.

    Lately, however, the only development that has been seen at DBP is infighting among its officials and a bitter feud among Noynoy’s appointees and the past leadership of the bank.

    The conflict within the DBP is a microcosm of the many conflicts within the fractious Noynoy administration.

    The public, for instance, is now used to hearing about the Balay and the Samar factions’ internal struggle in Malacañang and the almost public display of one faction pathetically trying to outdo the other.

    There were also several instances when Noynoy’s yellow people tried to impose their will on the agencies that they colonize.

    At the DBP, the yellow appointees backed by the minions of Noynoy’s cronies are supposedly on a crusade to cleanse the state bank of its crooked past.

    On the cross hair of the yellow appointees are the former DBP officials and businessman Roberto Ongpin who has long been suspected by the yellows and the new administration officials to be a chief crony of former First Gentleman Mike Arroyo.

    Employees were not asked but ordered to turn in what they knew about past irregular dealings and when the evidence is considered insufficient, it does not matter that these are manufactured to suit their whims.

    The turf battle at DBP has reached international notice, with credit watchdog Standard and Poors issuing a subtle warning about a possible downgrade of DBP’s credit grade that would make it more expensive, if not difficult, for the bank to borrow abroad or the value of guarantees that the bank gives on loans to private companies degraded.

    The derating on the bank, it being an integral part of government, may also reflect on the overall credit grade of the country.

    The conflict at DBP only goes to show the shortsighted character of Noynoy and the people around him in running the government or its different arms.

    Noynoy similarly has the penchant of deciding based on immediate needs while not seeing the future implications of his decisions. A clear proof of this, was his donating $1 million to the Japanese victims of the earthquake that happened way back in March.

    The day after the donation, while he was still in Japan, typhoon “Pedring” struck, devastating most of Luzon, including Metro Manila.

    Those left in the country found out to their dismay that only P3 million was left in the calamity fund to be spent which would not last for long for the many victims of the devastation caused by the typhoon.

    The DBP situation would not have been blown out of proportion had the appointees of Noynoy shed their cloak of conceit and sought cooperation from employees of the bank instead of threatening them.

    As it turned out, the appointees of Noynoy are being resisted by those who they are supposed to work with in improving the performance of the state bank.

    Consider that the first order of business of Noynoy’s appointees was to dig up alleged irregular loans transacted with the bank instead of attending to the many requests from troubled business sectors for government assistance.

    A serious reform at all levels of government is indeed expected from the administration of Noynoy but not through an abrasive mob-like manner that the yellow crowd surrounding to which Noynoy is accustomed.

    Now, trouble at the DBP is near tipping point with the employees up to the managerial level appears to be closing ranks against the appointees of Noynoy.

    The resolution of the conflict in the state bank would require either most of the employees being terminated or the appointees of Noynoy being sent packing out of DBP.

    The latter is more ideal but would likely not happen with Noynoy’s help.

    Listed firms’ earnings drop 15% in first half

    Net earnings of listed companies declined in the first half reflecting a slowdown in the spending power of consumers due to increased prices, the head of the local bourse said.

    Despite a 15.3-percent increase in combined revenues to P1.85 trillion during the period, net earnings of listed firms slipped seven percent to P219.66 billion from P236.23 billion a year ago.

    PSE president Hans Sicat said the drop in earnings of listed firms was the result of several factors, including higher input prices, which may have led to increased expenses.

    “Consumer demand also seems to have slowed down as a result of these price pressures, along with the cautious sentiment over adverse developments in the global markets,” he added.

    Based on PSE data, the industrial sector recorded a 31.1 percent decline in income due to a higher base registered by some firms the previous year, which came from one-time gains, reflected in the decline in the net earnings of First Philippine Holdings Corp. Also, lower sales volume and average selling prices affected the net earnings of Energy Development Corp. and Aboitiz Power Corp. First Gen Corp., on the other hand, posted lower equity in net earnings of associates.

    Similarly, the Holdings Firms sector reported a 10.3 percent decline in consolidated net earnings largely due to lower net earnings in associates or subsidiaries posted by firms such as Lopez Holdings Corp., JG Summit Holdings and Aboitiz Equity Ventures.

    Combined net earnings of firms under the services sector dipped by 9.2 percent as net profits of airline companies — PAL Holdings Inc. and Cebu Air Inc. — were adversely affected by the spike in average aviation fuel prices while the absence of political advertisements pulled down television and radio airtime revenues of ABS-CBN Corp. and GMA Network Inc.

    The financial sector’s collective earnings bucked the downtrend owing largely to improved trading gains and the increase in service charges and fees posted by some banks such as Banco de Oro Unibank and Union Bank of the Philippines. Net interest incomes of Metropolitan Bank and Trust Co. and Bank of the Philippine Islands grew following increases in interest rates on loans, receivables and trading securities.

    The property sector also posted a 30.6 percent increase in combined net earnings. A nonrecurring gain from the sale of investment in available-for-sale shares bolstered Megaworld Corp.’s (MEG) net income. Increased revenues from real estate sales through improved sales volumes of both residential units and commercial lots also boosted net earnings of Ayala Land Inc. and SM Development Corp. while SM Prime Holdings Inc.’s net earnings registered growth as new malls were opened and old malls underwent expansions.

    The mining and oil sector’s aggregate net income surged 184.1 percent as average global metal prices improved. Philex Mining Corp.’s revenue from gold, copper, and silver, petroleum and coal posted double digit growth. Semirara Mining Corp.’s consolidated revenues from coal and power increased due to higher coal prices. Similarly, Nickel Asia Corp.’s net income rose with the increase in nickel ore prices.

    FMIC, Japan’s Mitsui sign agreement to expand Toyota dealership

    FIRST Metro Investment Corp. (FMIC) has signed a deal with Mitsui & Co. Ltd. of Japan to expand the Philippine dealership of Toyota Motors.
    In a disclosure to the Philippine Stock Exchange, the investment banking arm of the Metrobank group
    said it signed a memorandum of agreement with the Japanese firm for the latter’s entry into the marketing and distribution of Toyota vehicles.

    “Through the strategic partnership, it is envisioned that the Metrobank group and Mitsui will enhance the nationwide dealership business of Toyota,” said FMIC.

    FMIC shares were unchanged at P62.30 each on Thursday.

    President Benigno Aquino 3rd witnessed the signing of the FMIC-Mitsui agreement during his just-concluded working visit to Japan.

    Toyota Motor Philippines Corp. is a joint venture between Mitsui and the Metrobank group.

    Toyota Motor Corp. pledged P3.6 billion in new investment to expand its dealership network in the
    Philippines, producing 5,000 new jobs until 2016.

    The investment will add 36 dealerships to the current network of 29, bringing Toyota Motor’s total investment in the Philippines to P20 billion.

    TMPC said it had resumed full operations in its Santa Rosa plant last June after cutting down production in the aftermath of the twin disaster that struck Japan early this year.

    The auto firm sold 34,190 units in the first eight months of the year, down from last year’s 35,594 units, for a 36.72-percent share of the Philippine market. In August alone, sales dropped to 4,832 vehicles from the 4,374 sold in the previous month.

    Who’s Noy’s boss really?

    President Aquino wants those who participated in Tuesday’s labor protest staged by the members of the Philippine Airlines Employees Association (Palea) haled to court for economic sabotage only to relent from such position apparently upon realizing he opened his mouth too soon.

    In making such a knee-jerk reaction over a legitimate grievance expressed through a legitimate mass action, Aquino only succeeded in making it appear that Malacañang is the head office of the airline company. His defense that 14,000 passengers were stranded because of such protest walkout by on-duty Palea members objectively does not justify his interference in an intra-corporate squabble.

    The stranded passengers have all the reasons to be angry for missing their flights. The tickets issued them by PAL after paying the fare cost are a valid contract of conveyance entered into by the passengers and the airline company. Under such contract, PAL bound itself to the obligation of bringing the passengers to their agreed destination on a specified date and time.

    Only an act of God as contemplated by law can excuse the airline company from performing its obligation under such contract of conveyance. Unfortunately, the wildcat labor strike such as the one staged by Palea members Tuesday has never been considered by law an act of God. It is an occurrence that is foreseeable especially in the case of PAL.

    The company is slated to commence the termination of some 2,000 employees starting tomorrow. The termination is the logical consequence of PAL’s decision to spin off by outsourcing some of its internal services. The move had been allowed by the courts and sanctioned by Malacañang no less.

    Expectedly, Palea opposed this move. In fact, the company’s labor union had filed in the past a notice of strike because of this issue. Unrest marred the company since this decision to spin off by outsourcing some of its internal services was made known to everyone.

    PAL under the circumstances should have prepared for any eventuality because of the prevailing atmosphere in the company. Unfortunately, Tuesday’s labor strike proved beyond doubt that the company was not preparing for any contingency measures in the likelihood of retaliatory action that the union may direct against it.

    The result of the company’s inability to take preemptive measures was catastrophic. Logically speaking, PAL can be accused of exacerbating Tuesday’s situation. Its failure to put in place contingency measures for such an eventuality, something that iy should have anticipated, just pushed the damage to epic proportions.

    Undeniably, under our jurisdiction the working class is always under the mercy of the capitalist. The television footage of Tuesday’s evening news of the Palea strike proved this. Protesting employees were no match to the combined forces of the police and in-house security personnel of the company who pushed and literally carried the former out of the Centennial terminal complex.

    Protest actions such as the one staged by the Palea members are legitimate courses of action granted the workers. This is a mechanism enshrined in the Constitution and given flesh in several enabling laws under the principle of social justice. Since labor is practically powerless if ranged against capital, its only power to check on the abuses of the former is to stage a protest action.

    This constitutional and legal points were unfortunately missed by Aquino. With his reaction to the Palea protest, he only displayed his utter lack of understanding about the social justice principles enshrined in numerous labor legislations. His mindset is still that of a Hacienda Luisita owner where the workers are denied their basic rights to even question management’s exercise of its so-called prerogatives.

    Aquino should be advised to slow down on his impulsive reactions. He should be reminded that he is the President of both the capitalist and the lowly worker. Since the laboring class in this country is practically powerless when ranged against business entrepreneurs, government should serve as the equalizer to even the playing field between the two. Sadly, what he did was the equal opposite.
