    correct me if I am wrong, but I think its Juan who plans to take the property for himself but not Pedro...

    ok. i think there's a misunderstanding so let me rephrase my question.
    its like this. is there a way where Juan can own Papa Pedro's lot?
    or how would it be settled in a way nga ma-acquire ni Juan ang lot ni Papa Pedro and in the span of time ma-angkon ni Juan ang iyang property + the lot.

    rent to own nalang na bai.. rentahan ni juan ang lot within a period of time depende lang sa masabotan ug pila sad din pila ka years..

    two options to own the lot legally:
    1. Ask it from your father
    2. buy it

    ...... this does not seem so simple as it may sound.......there are a lot of variables on estate properties.
    are there siblings involve other than Juan and Pedro ?... inheritance and succesion is a very complicated estate matter..... better get a good,
    trusted and proven Lawyer out there that specializes in this matter.
    ...just my 2 cents !

    better get a lawyer to sort things out and have all kasabutan in black and white para walay samok. usahay baya wala sa duha ang magdala ug tigaw kundili naa sa uban tao like for example asawa ni Juan.

    before constructing bro, juan should just rent the lot(assuming juan's fund is limited with the construction of the apartment). thereby giving monthly rent to his father pedro.
    make contract up to 15-20 years.

    if the apartment is already built. juan pays his rents and ask his father pedro about a contract for how long he can use the lot. income from the apartment is own by juan, it's like juan sublease the property
    if juan have the money, buy the property from pedro, as soon as possible if juan really likes the property.

    (Im assuming their are other siblings like maria and jose bec. juan is not sure if he can own the lot as inheritance when pedro dies)

    maria and jose and juan has equal rights of the property so if pedro dies, juan may pay maria and jose the monetary value divided by the rightful owners to acquire the property.

    dont forget to pay the inheritance tax. hehe

    nag lisud2x raka sa imung sayun nga problema, you ignore my advice.
    Don't stress yourself to Donald Trump he is far more intellectual and experience person than you are, dli nimu ma absord iyang teaching esp. newbie ka in this industry.
    2nd some Real Estate Laws in USA doesn't apply in our country.

    develop your fathers land and propose a 70-30 / 60-40 profit sharing. by that dli ka ma problema in the near future if ever mag away mo. or if ever mamatay imung amahan then it will be an advantage sa imuha in many ways.

    less hastle and a big change to own the whole property than your siblings.
