Today at RTC Branch 28, I witnessed a hearing regarding a wife who sued her husband under RA 9262 (Anti Violence against Women). Here's the gist:
The woman issued an affidavit of desistance, saying she has forgiven her husband whom she believed was truthful in changing his ways and promised not to hurt her anymore. She wants the court to dismiss the case she filed against her husband and set him free (the guy's in prison). The judge ruled that the filing of her affidavit of desistance is not enough for the court to dismiss the case. The court asked her how often the physical abuse happens, and the woman said often when the husband is drunk. The judge then ruled further that the case will have to go on and the trial to proceed and that the court is doing the woman a favor as it has seen many instances of the 'battered woman syndrome' where women usually back off, forgive their husbands only to be beaten again. If the woman wanted to help the husband, she might as well just pay for the bail so her husband can be set free, but the case must go on.
I lauded the judge's decision and ruling.
