(UPDATE) He may have garnered the most number of votes in last May's polls, but because he spent too much for his campaign, Laguna Governor ER Ejercito has been disqualified.
The Commission on Elections (Comelec) First Division on Thursday disqualified Ejercito for overspending in the May 2013 polls, the poll body’s spokesperson James Jimenez said.
Ejercito, who ran under the United Nationalist Alliance, led the gubernatorial race in Laguna. His closest rival was Liberal Party’s Edgar San Luis.
He may still appeal the Comelec decision, however, with Jimenez saying Ejercito has five days to file a motion for reconsideration before the poll body.
"In case of the disqualification attaining finality, the governor will be replaced by the vice-governor, not the one who got the second place," Jimenez said via Twitter.
Comelec Chair Sixto Brillantes Jr. said Ejercito, the nephew of Manila Mayor Joseph Estrada, spent some P6 million for television advertisements alone.
Under election laws, and based on the number of voters in the province of Laguna, Ejercito was allowed to spend only P4.5 million for his gubernatorial bid.
Candidates may only spend P3 per voter from his own funds and his party is allowed to spend only P5 per voter from, Comelec Resolution 9476 said.
"Mayo unta kung ma disqualify pud ang ubang mga politiko ....Good example ni sa mga violators"
