    Default Legal Advice for Globe Subscribers


    I would like to address my concern to Istoryan lawyers here:

    This is my case:

    1. I subscribed to Globe with their broadband internet plus landline last August 2006, ever since their is a problem with my connection, its intermittent, i thought its ok, i just call with a worst problem happened like their is no connection. But an honest and knowledgeable technical personnel answered me just this month that, there is really a great problem with my internet activity coz its intermiitent ever since August 2006. So I demand for a thorough inspectionl.

    2. Last week, an honest technician called me and boldly confess the cause of my internet problem, he mentioned that the cabinet where my connection is tapped is defective ever since and globe just started repair it last 18th of February and he mention that it will be ok for one motn to two month because they are rehabilitating the cabinet, he also mention that they are a lot of subscribers in our area who are also connection with the same cabinet, unsubscribed. Aside from intermittent internet connection, i also experience an intermittent landline connection.

    What would be my rights as a subscriber who is paying the bills on time?

    Who am I going to complaint since Globe is not offering the right services for my right payment?

    What would be my action so that my concern would be given fair response from the company?

    bro ako rang ma advice kuha ug legal assistance,, preferably kanang BS ECE at the same time abogado, kanang license gyud nga manlalaban both pag ka engr ug abogado, wa man gihapoy polos ug mo file tang complain bisan DTI or NTC pa ug walay man lalaban nato sayonsayon rapud ta ana nila, ang buhaton anang mga klasihan ahensha sa governno,,,ang apason lng ana nila nga basta ma Settled lng ang complain bahala nag imong rights and damages wala ma comply, para nila basta ma human lng ang ilang buhat bisan ang hustisha wala mahatag. Ug sa NLRC pana padaghanay lng ug case solve, haron ingon nga nag kugi gyud ug work, without knowing justice is not properly serve.

    Kani basi sa akong kasinati-an before, only nga labor case tong ako, nag file kog complain sa NLRC, wala ko mag kuhag abogado kay salig ko ani nga ahensha sa gobyerno, pero pakyas ko wa gyud diay ma pili aning mga polpol nga gobyerno, imbess mo demand ka for one example lng ha, nga mangayo kag copy lng sa contract nga gi signan nimo pag ka hire nimo, mas molaban pa ang arbetier sa companya, ug imbis ang companya pangotan-on why wla sila mag hatag ug copy sa contract sa employee, ako na nooy gi pangutana nganong mangayo pakog contract nga nag resign naman ko, akong gi ingnan ako manang right as employee mga my own copy ko ana, when in fact naa sa contract ang proof unsa nga mga kasabotan ang wala nila ma comply. na wad-an kug gana oy head man unta sa NLRC ang nag handle sa case, buwaya kaayong dako.

    you are right, we need to have the help of the lawyer and the ECE people, so thats why i am appealing here to the people here in istorya who are lawyers and ECE personnel.

    We know that we could seldom meet people in the government that have really has the heart for public service, most people in the government are motivated by money.

    force majeure...

    since the start you had intermittent connection

    that was already a wake up call for you to cancel the subscription.

    it already tells you that their equipment is not capable.... but you continued.... now its getting worse

    the best you can do is to cancel the subscription and not pay the termination fee...

    there are limits to what the equipment can do.... and that is beyond what globe can do....

    the closer you are to their cabinet the better your connection

    the farther you are you need an lot of luck....

    Globe offers the most affordable broadband and landline telephone connection, if I could get a good value of my money by doing this I'll do it, by cutting off the subscription is not a good option for me as of this moment.

    well affordale doesn't mean its reliable in YOUR area..

    it maybe good in some areas of cebu and it maybe not so good....

    as it appears that the cabinet was "defective" from the start, then that's not force majeure. force majeure is an act of god, or an event beyond the control of either party while the contract is being implemented.

    on the other hand, to say that there are limits to what equipment can do won't fly either. if you knew beforehand that you will have difficulty delivering your part of the agreement, then you aren't acting in good faith when you entered into the contract. depending on the facts and the proof, this previous knowledge could result in your having acted fraudulently in inducing the other party to agree to the contract. this would result in a civil case and possibly, a criminal case....

    In a perfect world everyone should have a stable, reliable broadband...

    but we are not in a perfect world.

    suffice to say

    Its trial and error..... if you had 1 week of poor unstable connection... that means the equipment is not capable of delivering broadband...

    with that in mind you can cancel the service....

    so always becareful and not to jump on any promotions.... assess everything....

    the nearer you are to the cabinet the better your connection.... on the other hand if you are far from the cabinet then its all about luck....

    You can ask globe to invest on a brandnew cabinet.... but it will go through an approval process which will take time...

    so knowing all this.... its your call.... will you accept unstable service or just wait until the service gets better and that is the time you subscribe
