    Default Non-compete clause of some call centers


    Non-compete clause is a contract agreement between the employer and the employee - wherein, you could not work for competitors within a certain period of time (commonly 6 months - 1 year) after you leave or resign from the company where you have that contract. Have you heard about non-compete clauses in some call centers here in Cebu? Is it enforceable? Is it legal to impose such clause as part of the job offer?

    i've signed one before at wats. i guess it is legal. i heard similar cases but not from the company i've worked with before. i think it is enforceable.

    There is a comprehensive discussion of this topic @ another popular forum for Manila BPO employees. The general concensus is it's uncostitutional and unfair to the employee. Our Labor laws will always favor the employee. Dont be worried of such, been there , done that

    Presumably legal, unless and until the Supreme Court says otherwise.

    The opinions stated here are right in one aspect or the other. I am a lawyer by profession and I have been in the call center industry for five years. Though the non-compete clause may be valid in one way or another, our Labor code and the Philippine Constitution also set forth that over and above anything else, the worker has the right to a decent "living" and must not be constrained to a contract if it affects his right to live.

    some companies "lift" this clause kung magpangita na silag tao. i dont exactly know how everything plays out behind the scenes pero based on experience they do that.

    ang problema lang pud is, if ang imong company na g applyan mo honor jud sa NCC.
    bisag dili pa ka gukdon sa imong gbyaan, d man pud ka dawatun sa imong balhinan. so ang alaut ang employado. luoy astang pamilya magutman.

    bati ni siya. ang gprotectahan ani is ang mga companiya ra. at the expense of sacrificing our career growth.
