    Default clarification on transfering to a new house after paying equity


    mag ask lng ko mga bro and sis.

    my parents fiance bought a new house somewhere in mandaue.

    we already paid the equity last may 2012 but until now wala sila kabalhin kay naa problema ang papers sa developer.

    something like capital gains tax ang wala nabayaran sa BIR.

    we paid 980,000.00.sige lang sila og saad na pwede na maka balhin pero hangtod karon kay wala pa.

    WHAT SHOULD WE DO?CAN WE STILL WITHDRAW THE EQUITY?DO WE STILL HAVE THE RIGHT?

    980k ang equity?
    you have every right to withdraw if dili mka deliver ang developer. be vigilant in choosing a developer. daghan hokus pukos diha. Akong developer napili kay maayo kaayo.

    If you don't mind, can you pm me the developer? It's very important to check on the developer's background for buying properties are not a small thing to be laxed of.

    OnT: It is the developer's negligence so you have the right to withdraw. Capital Gain Tax is to be shouldered by the seller unless stated otherwise.

    we have given them so much time to comply with the documents they need to submit.

    we gave them an ultimatum last december pero karon wala pami kabalhin.

    pag inisug, yaw pag itoy2 ana nila, dghan na run binuang ana, mas mau jud ilhun nimu daan before ka mukuha...
    dakua pud sa imo equity...

    Pls. refer to your contract TS usually the equity is 20% of the principal value meaning medyo dako jud ni diay nga property...

    if I may ask is this thru Financing, Cash or Pag ibig?

    Again it is consumer rights to withdraw if your developer or seller can't deliver the said promises...usually nay na withdrawal fee but in this case pede rana ma void...sa ila man ang problema...

    paid the equity in cash then the remaining would be bank financing.

    Did you try to visit the said property? unsay update coming from them?

    If di pa jud cla maka deliver sa ila promise better get the funds - full amount they have no rights to impose penalty on that and if gahi jud cla better get a good lawyer.

    The usual story... hhayyzz.. sigehi lang ug tawag TS, if dili gyud pwede. Dad-ig abogado didto sa office nila, then there and then pahimo-a ug kasolatan, else withdraw dayon. Walay daghan istorya.

    unsa name sa developer ts? pm ko pls kay para ma-aware pud ko tawon... mahadlok pud ta aning dili makuha atong equity oi.
