    Can an employee be compelled to render overtime?

    When an employee spends additional time for work, he puts in more physical and mental effort. It is but proper that he be compensated for that. He is also delayed in going home and cannot spend time with family and enjoy the comforts of his home. As such, the law discourages employers to require employees to work overtime. Generally, he cannot compel the employee to render overtime, except in certain instances (Sec 10, Rule I, Bk. III, IRR) to wit:

    1) When the country is at war or when any other national or local emergency has been declared by the National Assembly or the Chief Executive;

    2) When overtime work is necessary to prevent loss of life or property, or in case of imminent danger to public safety due to actual or impending emergency in the locality caused by serious accident, fire, floods, typhoons, earthquake, epidemic or other disaster or calamities;

    3) When there is urgent work to be performed on machineries, installations, or equipment, in order to avoid serious loss or damage to the employer or some other causes of similar nature;

    4) When the work is necessary to prevent loss or damage to perishable goods;

    5) When the completion or continuation of work started before the 8th hour is necessary to prevent serious obstruction or prejudice to the business or operations of the employer;

    6) When overtime work is necessary to avail of favorable weather or environmental conditions where performance or quality of work is dependent thereon.
    ==================

    WE had this arguement before sa Convergys (lets hide the account name into T _ _ ) u know the rest, the account itself were having struggles in maintaining the vol. of calls to be handled due to manpower issues, and as they say every call that comes in is money... so our SOM mandated a required OT of lets say 3-5 hrs ot PER week, any days as long as u hit the 5hrs ot, thats 20hrs OT for one month..

    considering many of our fellow country man also has familys and life after work, some declined and some wanted it bec. its money.

    a waiver was sent out that for those who do not apply to the OT's will get an infraction or lets say a suspension.

    then here comes the arguement. The mandatory waiver to be signed is for you to acknowledge to do the OT and failure to sign will be a sense of insubordination.

    one of the CONVERGYS SOM added this line to the waiver

    "2) When overtime work is necessary to prevent loss of life or property, or in case of imminent danger to public safety due to actual or impending emergency in the locality caused by serious accident, fire, floods, typhoons, earthquake, epidemic or other disaster or calamities;"

    then we say, yeah account is losing it self to be honest due to issues(that was before) - the loss of property, the account it self is losing but to be general about it, property holds all the assets of CONVERGYS, where convergys is not really losing it self, just an account and there were not particular break down of how the account was losing such money

    and this one as well

    4) When the work is necessary to prevent loss or damage to perishable goods;

    all the law stated for req. overtime is really vague, no clear description to what it is...

    to make it short, yes you can decline to render OT if what u think what you have done is enough...

    if they force you to do so and tag u as insubordination, raise it up to your HR sa amo side.. naka daog mi which ila gi usab ang waiver, so dili na mandatory amo ot.. lols

    hahha this is definitely convergys.. comcast.... we had to do mandatory OT for 2 hrs everyday.... it's hard on my part since i have a family... i did tried not doing an OT in some cases na i really am tired... niresign na lang ko sa kakapoy hahah got burnout...

    take note that during my 2 yrs in service to the company i've never been absent or late... i guess the OT part is my "Achilles heel" hahaha plus i could not take the verbal abuse from an OM... tho not directed to me but to everybody.

    to answer your question, i guess it's legal because it's paid... the only hard part is the "mandatory" OT.

    which is illegal and declinable because there is supposed to be no such thing as mandatory OT according to book 1 of labor codes.

    sakto jud na.., honestsai lang.. Pag interview ninyu, e ask good mo na willing ka ba mo render og OT? tapos yes jud na ang tubag pra ma dawat. pag sure mo dha. Napa sad lain question.. are you willing to work during holidays.. yes gihapon ang tubag pra ma dawat.. dli ba yes ang gipang tobag ani>/ kong ge record na, pildi namo daan. tapos asa man ang inyung integredad kong dli man mo, mo toman sa inyung mga yes. tapos reklamador kau na dunai OT, Syempre duna jud nai OT ang work, dli na kalikayan. If you love your job and willing ka mo serbisyu , you will do the OT without any conditions.

    tapos naa bya jud nas contrata na imo ge pirmahan na mo render mog OT if needed.

    nya tarbahu gud ni xa, kong walai tarbahu magcge pangita tarbahu.. kng dona nai tarbahu mangita gihapon og lain... dli man lang ma kontento, nya ge dawat gud mo og ge sweldo.an og tarong/ kong wala mo sweldohi kana angay na e reklamo.

    Greywolf is right.. there is no such things as mandatory ot.. but if u look it out in the LAW, it has so many flaws, you can only force a mandatory OT if

    1. THE COMPANY It self is losing... if ur in callcenter which holds an account, the company is never really losing at all, just the account it self, so mandatory OT are really not mandatory if u look at them, u can opt not to take em...
