CEBU CITY -- Hours after he was stopped from posting bail in one of three cases, Joavan Fernandez escaped from his captors around midnight.
All personnel of the Talisay City Police Station were ordered to search for Mayor Socrates Fernandez’s adopted son.
The acting Talisay City police chief, Superintendent Elmer Lim, said they will not rest until Joavan is captured again.
An inmate, who refused to identify himself, told reporters that around 11 p.m. Wednesday, he and another detainee were cleaning the detention cell of the Talisay City Police substation when they heard Joavan ask the jailer on duty, PO3 Leandro Azarcon, to allow him to get out of the cell to talk to his four children.
The substation is located within City Hall. Mayor Fernandez told Sun.Star Cebu that he was not aware that Joavan escaped. He said he was in Mindanao to attend a seminar.
SPO1 Mikey Espina, one of the investigators on Joavan’s case, said that for humanitarian reasons, Azarcon allowed Joavan to get out of the jail to see his children, who were accompanied by their mother and some friends.
Joavan went out along with two inmates who were cleaning the cells.

But a few minutes later, Azarcon noticed that Joavan’s kids and their mother were no longer in the vicinity of the substation. The policeman checked the detention cell but only the two inmates were there.
Sun.Star Cebu tried to interview Azarcon but he refused.
A witness told the police that Joavan allegedly rode a green SUV with a government license plate. The vehicle reportedly left the City Hall compound through the back gate, which leads to Barangay Mohon.
Espina said the police cannot assure Joavan’s safety if he resists capture. “Niabusar na siya (He abused our kindness),” Espina told reporters.
Lim, in a separate interview, said he and the entire city police are involved in the hunt for the mayor’s adopted son.
A few hours before the escape, Joavan was not allowed to post bail Wednesday for alleged possession of a deadly explosive device.
While he was able to make bail for illegal possession of firearms and violation of the election gun ban, the mayor’s son wasn’t able to post bail in relation to an alleged violation of Republic Act 9516. This law imposes penalties for illegal possession of grenades and other explosives.
In an earlier interview, also Wednesday, Joavan said his lawyers were preparing the charges against Police Chief Lim and other police personnel for allegedly planting evidence against him.
Talisay City Prosecutor Marshall Rubia said that while Joavan could have posted P12,000 as bail for illegal possession of firearms and violation of the election gun ban, he could not bail out of temporary detention due to a charge for violation of RA 9516.
The charge was filed by the police after Joavan was caught carrying a pineapple-type grenade along with a handheld Dillinger Black Widow revolver with four bullets.
He was arrested last Monday night because of a bench warrant issued by Municipal Trial Court in Cities (MTCC) Judge Mario Manayon.
But Joavan said his lawyers are studying the possibility of filing a complaint against the Talisay City police over what had occurred last Monday.
Joavan also said he planned to post bail today, Thursday, after spending about a day in jail. He was formally charged last Tuesday afternoon.
When he was arrested last Monday, Joavan was staying in his father’s house in Southgate Subdivision in Barangay Bulacao when the police arrived and presented the warrant.
During his detention, Joavan claimed that the police planted evidence against him and even mauled him. But Lim denied the allegation and challenged Joavan’s camp to file a case against him and his men.
So... he gets to come and go from a cell as he pleases and even carries a grenade around with him. Wake up cops, time to take this guy down!
