Gandalf and the other humanoid characters were green screened. the creatures like the trolls, Durin's Bane etc were CGI. Uruk-hai were human sized and didn't need any trickery and the Orcs were literally manlets.
they could do the same here and green screen the Orcs and take care of the size relative to the humans problem, but that means the actors will be wearing body suits, prosthetics and make up instead of mocaps. suits are going to restrict their movements especially for actions and fights scenes. and they're not going to have any facial expressions unless they use animatronics to manipulate the facial structure which just ends up looking stiff and artificial, and it also takes away from the actor's own natural acting which motion capture is able to record. it's pretty much the same reason why Marvel decided to go CGI with the Hulk instead having Mark Ruffalo wear a body suit.
and hell, they can't go the route of what the LOTR films did with their Orcs unless they want the Warcraft and WoW fans to sperg out.
as for budget, New Zealand is pretty cheap and they didn't have 3D s--- then. also adjusted for inflation, ROTK probably would've cost 30 million more today.
