A vocalist and I were axed because previous band members came back. However, there was no formal business arrangement so I think the band was well within their "legal" rights to change members at anytime. Of course, we felt bad, but in the end, we were all mature about it and everyone ended up being friends. Such is the nature of this 'biz. It was a blessing in disguise because if I wasn't axed, I'd still be where that band is today and I've traveled much farther.
On the other hand, it's really strange that people are absolutely averse to signing contracts and then whine about being kicked out. Contracts worth both ways. They protect you and the band. Sadly, most band people I encounter just want the freedom to leave anytime but don't grant the freedom to be kicked out at anytime.
