MANILA, Philippines -- Detained opposition candidate Antonio Trillanes IV is the 11th senator-elect and is set to be proclaimed Friday, Commission on Elections (Comelec) chairman Benjamin Abalos said Thursday.
The decision to proclaim Trillanes, a former Navy lieutenant, was made by the Comelec, sitting as the National Board of Canvassers, after finishing the canvass of votes from Surigao del Norte.
Reynaldo Robles, Trillanes' lawyer, said he will ask a local court to allow his client to leave detention to attend the proclamation, scheduled at 9:30 a.m. Friday.
Robles also relayed Trillanes' gratitude to those who voted for him.
"Yung message niya ay pasasalamat [His message is one of gratitude],” Robles said.
"Since the vote for Trillanes is the public's choice, I hope they will grant [his temporary freedom] for his proclamation," Robles said in an interview with reporters after the end of the canvassing.
"We will ask the court that he be allowed to attend his proclamation, considering that he was voted by the public at the time he was in detention," Robles said.
Robles said they would also request the court later to allow Trillanes to attend Senate sessions.
"…Trillanes said that he does not want to abuse the trust of the people. He doesn't want to use this [his position] as a ticket way out of the detention,” Robles stressed.
“But we're asking that he be allowed to attend sessions. He finds no problem if he has to go back every night in his cell. He just wants to serve the people in accordance with the mandate given to him," he said.
Asked how his client intends to work while in detention, Robles said he expects Trillanes to focus only on his new job.
"Imagine he will now be making laws. When he wakes up in the morning, he will do nothing but work. Di sya pwedeng magbulakbol, mamasyal sa mall o mag-night club. Magigigng focused sya [He won't be able to skip sessions, go to the mall or go to nightclubs. He will be focused].
“He has a legislative program with 20 proposed bills on anti-corruption, poverty alleviation, and education. He is preparing those bills and hopes to file them when the Senate opens. This will of course include reforms in the military. Isa sa principal advocacy niya yan [That is one of his principal advocacies]," his lawyer added.
Robles pointed out that Trillanes might be the first senator of the country to serve from detention.
"In the late ‘70s, during the election of [members of the] interim Batasang Pambansa [National Legislature], there was a member of the parliament [in detention]. Ngayon lang ito [But this is the only case] as far as I know," he added.
Trillanes is being tried before civil and military courts for his role in a failed military mutiny in 2003.
Only one other Senate seat, the 12th, is still being contested. Currently holding the slot is opposition candidate Aquilino Pimentel III, who is followed by administration candidate Juan Miguel Zubiri.
Ten new senators were proclaimed last week following the May 14 mid-term polls, which were marred by violence and allegations of fraud and vote rigging.
The proclamation of the 11th and 12th slots in the 12 seats contested was delayed after a million votes remained uncounted for in the troubled southern island of Mindanao.
Abalos told reporters Thursday that it was "statistically improbable" for the remaining votes to affect the final tally for Trillanes.
Trillanes, who had no platform other than to seek President Gloria Macapagal-Arroyo's removal, now cements the opposition's majority control in the 24-seat Senate.
When the new congress sits, the Senate will only have 23 seats with one left vacant following the election of Senator Alfredo Lim as mayor of Manila.
Trillanes, whose vote was seen more as a protest against the president, has said that if elected he would seek to have Arroyo impeached for corruption.
Ex-Army colonel Gregorio Honasan, alleged to have provided tactical guidance for the mutineers and who is also being tried for this, was among the senators proclaimed last week.
The Makati regional trial court on Thursday deferred his arraignment while awaiting a decision on an appeal filed before the justice department.
Arroyo allies retain control of the 275-seat House of Representatives and most of the country's provincial posts following the May elections.
More than 130 people were killed nationwide during the three-month election campaign.
