Talisay cops tagged Ocampo when they saw sketch.
SPO1 Marcial Ocampo, the alleged gunman in the murder of Bantay Dagat Commission Director Elpidio “Jojo†dela Victoria, is no stranger to controversy.
Cebu Provincial Police Office Director Vicente Loot said SPO1 Ocampo was previously assigned with the Regional Anti-Illegal Drug Task Force in late ’90s where derogatory reports were made against him, although no witnesses surfaced.
A relative of Ocampo complained of his abusive attitude, but no administrative case was pursued because the problem was settled.
Minglanilla Chief Virgilio Apurado said Ocampo served as desk officer in their station, but because he has difficulty in hearing he was transferred in radio room.
Talisay policemen were the first to suspect Ocampo when the artist’s sketch of dela Victoria’s assailant was released.
Because Ocampo is familiar to them, they coordinated their action with the task force investigating dela Victoria’s death.
In 1999, Ocampo, along with a fellow policeman, was investigated for a perjury complaint filed by a couple in Barangay Pasil before the People’s Law Enforcement Board (Pleb) of Cebu City south.
Ocampo was then assigned at the defunct Task Force Barangay Against Narcotics Abuse and Traffickers (Task Force Banat) of the Police Regional Office (PRO) 7.
Ocampo led the task force in raiding a house in Pasil where they seized one medium pack of shabu, a .38 revolver and P140,000 cash.
The suspects, however, filed a counter-charge against Ocampo’s team for perjury before the Pleb.
The Pleb, in a resolution in 2003, dismissed the complaint.
In 2002, an administrative investigation was also conducted against Ocampo by the Regional Internal Affair Service (RIAS) 7 for allegedly brandishing an M-16 Armalite rifle and a pistol in a fight with a relative at their compound in Barangay Kalubihan, Cebu City.
Ocampo denied the allegation.
Before he was transferred to police stations under the Cebu Provincial Police Office, Ocampo served as an agent of Task Force Turista and an intelligence officer of the Regional Intelligence And Investigation Division.
Before his assignment at the Minglanilla Police Station about three years ago, Ocampo was detailed at the Santander Police Station.
During his stint at the Santander Police Station, Ocampo, Santander Mayor Wilson Wenceslao and PO3 Pablito Zoilo became respondents of administrative complaints of grave misconduct and oppression filed against them by one Antonio Baat before the Office of the Ombudsman for the Visayas.
Baat had filed a complaint against Wenceslao and the two policemen for trying to arrest him in a private wharf in Santander last June 15, 2003.
The anti-graft body, however, in a resolution last September cleared the mayor and the two policemen from any liability.
Ocampo, who was arrested by the Criminal Investigation and Detection Group (CIDG) 7 for allegedly killing dela Victoria, joined the service in 1988 through the Philippine Constabulary.
Ocampo’s legal counsel Vicente Fernandez II, in a separate interview said his client’s largest criminal record is oral defamation.
“Unya karon, mopatay na hinuon og tawo (And now, he’s accused of killing someone)?†Fernandez said.
Fernandez confirmed that Ocampo has administrative cases, but the lawyer dismissed allegations that Ocampo has “drug habit.â€
“That’s why we filed a case against (Supt. Augusuto) Marquez (chief of the Regional Intelligence and Investigation Division) for identifying him as a drug dependent. He was cleared after we submitted documents, results of drug test. He also tested negative in a PNP random drug test,†Fernandez said.
