    Default Teacher Namugaw ug Estudyante sa mga Foreigner

    A TEACHER at the Compostela National High School faces a trafficking charge for allegedly recruiting two 14-year-old girls to have *** with foreigners.
    The Cebu Provincial Prosecutor's Office filed a complaint against Flor Marie Perez Baring for allegedly violating Republic Act (RA) 9208 (Anti-Trafficking in Persons) as amended by RA 10364 (Expanded Anti-Trafficking in Persons).
    The case is non-bailable and falls under qualified trafficking because the alleged victims are minors.


    The Regional Anti-Human Trafficking Task Force (RAHTTF) of the Police Regional Office (PRO) 7 filed last July a case before the prosecutor’s office against Baring based on the complaints of her two alleged victims, Mara and Bea (real identities withheld).
    In her counter-affidavit, the teacher denied the allegations, saying they were fabricated by the minors. She teaches music, arts, physical education and health.
    Dr. Carmelita Dulangon, Department of Education (DepEd) 7 director, said the teacher must face the case.
    But she said DepEd 7 cannot impose sanctions on Baring until she has been proven guilty in court. “We will wait for the final decision,” she said.
    Last July, Dulangon met with Baring in the DepEd 7 office. The DepEd 7 official advised Baring to answer the allegations.

    Cebu Provincial Schools Division Superintendent Arden Monisit said they do not have disciplinary authority on Baring.


    Complaints

    Senior Insp. Ma. Theresa Macatangay, RAHTTF head, said they received other complaints from Baring’s alleged human trafficking victims and the police are investigating them.
    RA 9208 punishes any person who “recruits, transports, transfers, harbors, provides, or receives a person by any means, including those done under the pretext of domestic or overseas employment or training or apprenticeship, for the purpose of prostitution, pornography, sexual exploitation, forced labor, slavery, involuntary servitude or debt bondage.”
    In Mara's affidavit, the girl said she confided to Bea in November last year that she needed money because she wanted to attend the wake of her grandmother. Baring allegedly heard both girls and joined in the conversation.
    “Ma'am...then told me that she has an American friend who can help me and who will marry me. The American is willing to send some money for me every month,” said Mara.
    “Ma’am...told me that the American is here in the Philippines and wants to meet with me. Because I was in need of money...I agreed to meet with the American friend of Ma'am on the same day.”

    Lahug hotel

    Baring allegedly brought Mara to a hotel in Barangay Lahug, Cebu City to meet the foreigner. Baring allegedly told Mara that she will get P1,000 if she agrees to have *** with the foreigner.
    “When we entered the hotel room, Ma'am told me to go to the bathroom right away and take a shower. When I came out, I told Ma'am that I changed my mind and I am not going to have *** with the man because I was afraid,” said Mara.
    The teacher allegedly told Mara to lie in bed with the foreigner. Mara said she finally agreed because she was afraid. After the sexual act, the foreigner gave Mara P1,000.
    In December last year, Baring told Mara that another foreigner wanted to meet her. But she avoided the teacher.

    Promise

    Bea said Baring persuaded her to have *** with a foreigner in October last year. The teacher allegedly accompanied her to a hotel in Lahug, Cebu City where the foreigner was staying.
    “I agreed to meet with her foreigner friend because of the promise that they will help my family. I also wanted to be able to help my parents and siblings,” Bea said in her affidavit.
    The foreigner paid P2,500. Baring allegedly gave Bea P2,000 and kept the P500.
    Bea said she accompanied Baring and two girls to the same Lahug hotel last February.
    One of the girls brought along her boyfriend, who did not know what happened.
    Bea said she stayed with the girl’s boyfriend at an eatery outside the hotel. When the girls came out with Baring, the teacher allegedly instructed Bea to tell the boyfriend that they were cleaning a hotel room.
    The two other girls, however, did not execute affidavits against Baring.
